Madras High Court stays Tamil Nadu government’s direction banning use of old vehicles for driving schools

The Madras High Court on Saturday stayed the operation of a Tamil Nadu government order banning the use of vehicles older than eight years for running schools in the state.

Justice R Suresh Kumar passed the interim order on a writ petition by the Tamil Nadu Federation of Driving Schools and granted the injunction.

The court ordered an injunction to restrain the defendants from insisting on the members of the petitioner federation merely because those vehicles had a life span of eight years in line with the impugned clause in a circular dated November 11, 2011, for a period of four weeks. has completed. , it said.

“After hearing the submissions made by the counsel for the petitioner and after going through the relevant provisions mentioned above under the Motor Vehicles Act and the rules made therein and going through the disputed section of the circular issued in 2011, it appears to the court that that some interim arrangement may be made.

“Accordingly, this Court is inclined to order an injunction to the defendants and their men, from urging the members of the petitioner’s union to replace their existing vehicles or to be pressed into service merely because those vehicles have a life of eight years.” The period has been completed vide clause 8.1.1 of circular No. 62 dated November 11, 2011,” the bench said.
