Punjab and Haryana High Court asks two SHOs to present ‘missing’ man

The Punjab and Haryana High Court has sought affidavits from two Station House Officers (SHOs) on a habeas corpus petition filed by a UT resident against the illegal confinement of his 23-year-old son by the Chandigarh Police.

Petitioner Sunita Rani, through her advocate Padmakant Dwivedi, has filed a petition seeking an order to produce her son, who has been illegally committed by the defendants in connection with an armed robbery in Sector 28, with effect from the evening of November 24, 2021. was taken into custody.

The petitioner had alleged before the High Court that his son was harassed by the policemen.

The 23-year-old has since returned home after filing a petition in the court.

As soon as the matter came up for hearing before the HC, counsel appearing for Chandigarh Police submitted that the 23-year-old was never taken into illegal custody, nor was anyone under the jurisdiction of the Union Territory. Also limited in police station. resident of Chandigarh.

The Division Bench of Justice Sureshwar Thakur said on submission to Chandigarh Police, “If so, the disclosure of the above fact, on affidavit, within a period of one week, filed by co-respondent SHO PS Industrial Area Phase 1 and .SHO PS 26.”

The bench further said that both the SHOs are directed to ensure that the person is produced before the court on November 30, 2021.
