Jackson County judge orders temporary closure of Rai’s Cafe

BLUE SPRINGS, MO (KCTV) — A Jackson County judge has granted a temporary restraining order closing Rae’s Cafe.

The order will last at least 21 days as per the order signed.

The order said that its violation “may extend to sanctions against the person or entity contravening the order.”

origin story

Jackson County is asking a judge to openly disobey a mask order for a temporary restraining order and a permanent injunction against Blue Springs restaurants.

The court order states that there have been 388 deaths due to COVID and says that we are in the midst of a global health crisis.

Former prosecutor Phil Levota said the legal battle for Rae’s Cafe would be an uphill and costly one.

He said, “The very interesting and specific petition for a restraining order was filed by Jackson County detailing each contact and violation of Rai’s Cafe in alleged violation of the mask mandate. Now we will see that the judge pleads.” But how do you rule,” he said. “Unfortunately, there’s going to be a costly and consequential lesson to the owners of Rae’s Cafe that you can’t just pat your nose at the law, even if you totally disagree with it. Even if you disagree with the mask mandate, we’re a Countries are when you disagree you have to follow the legal process to challenge the law, not just disobey the law.”

Earlier on Friday, the health department was given another letter to the owner as customers were in line for breakfast.

“There’s no court order! So, that’s all they can do!” declared owner Amanda Wohletz.

Rae’s Cafe has received another notice from Jackson County for closure.

Wohletz drops the order on the table outside, where customers pay a one-dollar cover charge to enter the restaurant that now considers itself a private club.

“Have a nice day. I’ll leave it there for everyone to see,” Wohetz said.

The new order was given with the support of Jackson County Sheriff’s Deputies, who went peacefully as customers told about the “play” and announced that they “won’t wear masks.”

The Jackson County Health Department’s new order reads, “Violation of this order constitutes an imminent danger and danger to public health, constitutes a public nuisance, and is punishable by fine, imprisonment or other measures available under the law.” “

It comes after a public fight between the Jackson County Health Department and Rae’s Cafe, located in Blue Springs.

Rae’s Cafe is no longer alone in its shift to private club ownership in an effort to avoid mask orders in Jackson County.

The restaurant lost its dining permit for violating the county’s mask ordinance. It reopened as a private club with a one dollar cover charge.

The county says they are seeking a court order from the judge to permanently close Rai’s Cafe.
