District Attorney Won’t Deny Criminal Charges in Fatal Shooting on “Rust” Set, New York Times Reports

“We haven’t ruled out anything,” Mary Carmack-Altwies, the Santa Fe County district attorney was quoted as saying in a phone interview to the Times. “At this point, everything is on the table, including criminal charges.”

Carmack-Altweis told the Times that the term “prop gun” is misleading and that the gun that killed Hutchins was a “legitimate gun”, describing it as a “suitable gun of the ancient era”.

Reportedly, Carmack-Altweiss said the investigation is focusing on ballistics to determine what kind of rounds were used, and who placed them in a gun fired by actor Alec Baldwin.

“There were a huge amount of bullets fired on this set, and we need to find out what type they were,” Carmack-Altweis was quoted as saying.

The district attorney also said that the crew members were using guns with live ammunition for target practice hours before the fatal shooting took place, “unconfirmed”.

The DA was partly alluding to the founder and CEO of wrap, Sharon Waxman told CNN’s Don Lemon on Monday — citing information from a person with knowledge of the set — members of the “Rust” crew used guns with live ammunition and shot Hutchins. A few hours before being shot, he was engaged in a pastime called “plinking”.

The Wrap reported that one of the guns used was later handed over to Baldwin, who killed 42-year-old Hutchins and wounded director Joel Souza.

Baldwin shuts down gun while practicing quick draw, says AD

According to a search warrant affidavit, Souza, who was wounded in the shoulder, told investigators that Baldwin was practicing drawing his gun, so the prop gun went off.

Souza spoke to investigators on Friday, according to an affidavit released Sunday by the Santa Fe County Sheriff’s Office.

The affidavit said he told them that Baldwin was “sitting in a pecking room in a church building, and he was practicing a cross draw.” A cross draw occurs when a shooter draws a weapon from a holster on the opposite side of the body.

According to the affidavit, Souza was looking over Hutchins’ shoulder “when she heard what sounded like a whip and then popped loudly”.

He also confirmed to an investigator that he had heard the term “cold gun” on set, implying that the firearm should have been empty.

According to the warrant, Souza said three people were handling the firearms for the scenes – they were checked by armorer and the assistant director first and then given to the actor using them.

The investigator said Souza was not aware that anyone on the set was being checked to see if he had ammunition on him before or after the scene was shot.

“The only thing that has been investigated is that they contain firearms to avoid live ammunition. There should never be live rounds in or near the scene,” Joel (Souza) said in the affidavit.

Representatives for Souza have not returned CNN’s requests for comment.

Attorney Gloria Allred said Tuesday that script supervisor Mamie Mitchell has evidence and information that will be “helpful in this investigation.”

Mitchell stood “very close” to Hutchins and Souza, she said, and called 911, Allred said.

“Helena was Mamie’s friend and close ally,” Allred said. “She is devastated by the loss of her friend, who was an extraordinary woman.”

Allred said the sheriff’s office interviewed Michelle and would not speak to the media.

Final autopsy results will take weeks

According to information from the New Mexico Office of the Medical Investigator, it could take weeks to complete the final medical examiner’s autopsy report on Hutchins’ death.

A spokesman declined to give details about the investigation, but said autopsy reports from his office usually take 6-10 weeks to complete.

A Sheriff’s Department official previously told CNN they are waiting for a forensic report from the medical examiner to determine what type of projectile killed Hutchins.

A spokesman for the medical examiner said the office does not publicly disclose information about the type of projectile that resulted in someone’s death until an autopsy report is finalized.

Past incidents reported on set

According to multiple news reports, there were at least two accidental prop gun discharges on the “Rust” set in the days before the fatal shooting.

The discharge occurred on 16 October, when crew members accidentally fired two rounds after the gun was described as “cold”. Los Angeles Times reported, citing two crew members who had reportedly witnessed the incident. It was not known whether live rounds were included in the discharge. No one was injured in the accidental discharge, the The Wall Street Journal reported.

According to an email sent to CNN from the New Mexico Department of the Environment (NMED), there were no complaints of unsafe conditions on the set of “Rust” sent to the Bureau of Occupational Health and Safety (OHSB) in New Mexico.

Armor, who designed the prop gun used by Baldwin on Thursday, was identified in search warrant documents as Hannah Gutierrez. She had recently completed work on her first project as Head Armour, she said in a September podcast interview.

“I was really nervous about it at first,” Gutierrez said of working as Head Armor on the set of “The Old Way” starring Nicolas Cage.

“I almost didn’t take the job because I wasn’t sure I was ready, but kept doing it, like it went really smoothly,” he said in an interview on the “Voice of the West” podcast. old West.

He said his job as an armorer ranged from teaching actors to wear gun belts to aiming and shooting.
