A Delhi court on Wednesday acquitted BJP MP Hans Raj Hans for allegedly giving vague information in his affidavit filed along with his nomination papers for the 2019 general election.
Additional Chief Metropolitan Magistrate Dharmendra Singh granted the relief to the North-West Delhi MP after finding that “no prima facie case is made out against him”.
Rajesh Lilothia, who contested the election against him, had filed a complaint.
Lilothia claimed that while filing the nomination form, Hans gave wrong information in the affidavit and he did not disclose material facts in it.
He alleged that the accused did not give correct information regarding his educational qualification, financial status of his wife, income of his dependents and the post held in the National Commission for Safai Karamcharis.
The court rejected the contention of the complainant that the politician had stated his educational qualification as ‘matriculation’, however, he pursued further studies and passed ‘PrEP’ (equivalent to class 11th) from DAV College, Jalandhar, it Given that he did not pass ‘PrEP’. ‘from college.
With regard to financial position, the complaint claimed that Hans’s wife was shown as a housewife in the affidavit, however, income tax arrears were shown against her in the relevant column.
The accused told the court that he was liable for capital gains on account of sale of immovable property and that he was neither in any employment nor was carrying on any business.
The court further observed that the accused had not listed his sons as dependents in the affidavit, so there was no need to mention his assets and income.
The court further observed that the accused had already resigned from the office of the National Commission for Safai Karamcharis at the time of filing his nomination.
The offense was punishable with imprisonment for a term which may extend to six months, or with fine, or with both. PTI
