$650,000 settlement reached in Orangeburg use of force

The City of Orangeburg has released footage from a bodycam worn by former public safety officer David Lance Dukes during an incident involving Clarence Gayyard.



The City of Orangeburg and 58-year-old Clarence Gaylord have settled a $650,000 settlement involving an alleged physical assault by an Orangeburg Department of Public Safety officer.

The settlement amount will be paid through the insurance carrier of the city.

On Wednesday morning, Bamberg and the City of Orangeburg announced that they would reach a settlement.

“It is our hope and expectation that every interaction between the public and officials with the Orangeburg Department of Public Safety will be professional and courteous,” said Orangeburg City Administrator Sydney Evering.

“We understand that these officers have a tough job and put their lives on the line every day, and for that we are very grateful. Most of our officers do their jobs with respect and ensure that the citizens they are assigned to protect and serve are treated fairly and with respect,” Evering continued.

He continued, “However, when an officer falls short of these expectations and behaves in an unfair way to his department and the city, that officer must be held accountable. That’s exactly what we did in this instance.”

In addition to apologizing to Gayyard and agreeing to a monetary settlement, the city has taken steps to ensure that ODPS is “moving in the right direction,” the statement said.

“We have named an interim police chief who will be tasked with reviewing use of force policies and procedures by the department,” Evering said.

“We are establishing a Citizens Task Force whose role will be to provide oversight and guidance regarding interactions between our residents and officials with the Orangeburg Department of Public Safety. We will continue to learn from this situation and provide guidance to Orangeburg. Will pledge to do our best for those living, working and traveling in.”

Charges against Duke are pending.
