Guwahati: Delhi Deputy Chief Minister Manish Sisodia Has prayed for quashing of the civil defamation case filed by the wife of Assam Chief Minister Himanta Biswa Sarma Riniki Bhuyan Sarma supposedly to link him to an alleged PPE The package provides for within-state rip-offs in 2020.
Sisodia’s counsel filed an application for dismissal of the petition against him under Order VII Rule 11 of the Civil Procedure Code (CPC), claiming that these were not true. The rule lays down six grounds for dismissal of a suit by the Court. The court fixed September 3 as the next date of hearing.
Last Month, Liniki Bhuyan Sarma had filed a civil defamation case of Rs 100 crore against Sisodia after he alleged during a press conference on June 4 that his agency was awarded a contract to manufacture PPE kits in 2020 without a tender process and the kits was bought by the federal government at a better price. Himanta was the health minister of the state at that time.
Bhuyan’s lawyer Padmadhar Nayak said, “The Kamrup (Metro) Civil Judge-I Court on June 22 issued notice to Sisodia to appear before the court on Monday either personally or by his counsel. Nevertheless, his lawyer made an application under Order VII Rule 11 of the CPC. He has prayed to the court that his application be disposed of before proceeding with the first matter.
Regarding the allegations leveled against Sarma, Nayak said that neither the government had floated any tender for PPE kits nor his consumer had participated in any tender process. “The Nationwide Health Mission, Assam explored the possible sources and ordered them for PPE kits as there was a shortage of kits at that time. Many failed to place orders. However my consumer collected 1485 kits from his personal supplies and donated it to NHM on 26th March, 2020.
